At Off The App, your privacy is of paramount importance.  We are committed to protecting your personal information and will be transparent about how we process your data.

This Privacy Policy (“Policy”) is applicable to all activities in which you engage, and data is gathered, on the Off The App website accessible through: https://offtheappdating.com/ (“Website”) and any other website and/or application operated by us (collectively “Off The App”), as well as to any information you provide to us through any other method including any offline point of contact. Each time you visit the Website, or provide us with information, you are accepting this Policy.

We advise you to review this Policy in its entirety before providing any data to us.

We appreciate your trust in us when you disclose your personal information.  This Policy is designed to help you understand how we collect, use and share your personal information and to help you understand your rights.

1.     WHO WE ARE

Arrow & Anchor, LLC, d/b/a Off The App, its parent, subsidiaries, and affiliates (collectively “Company,” “we,” “our,” or “us”) is a Wisconsin limited liability company with an address at 905 George Street #1071, De Pere, WI, 54115.

2.     INFORMATION WE COLLECT FROM YOU

In order for Off The App to properly function, the Company must collect certain relevant information about you.  The information is used primarily to create a profile of you and to suggest meaningful matches for you.  We may also collect information that is generated as you use our services, such as access logs, match preferences, and other data that allows us to create a meaningful user experience.  Please continue reading for more detailed information.

We collect information when you create an account and use the Website and/or App. We also collect information you share with us from third-party social network providers, and technical and behavioral information about your use of the Website. We also collect information contained in the messages you send through our Website and information from your phone book, if you grant us access to your phone book on your mobile device.  More information about the categories and sources of information is provided below:

2.1 Information you provide to us during use of Off The App and registration:

  • Registration information: We collect information when you create or update your user account.  This may include your name, gender, age, email, phone number, login name, password, address, date of birth, photo and signature.

  • Banking information: If you decide to purchase any tickets or other goods/services through the Website, you will be required to provide payment information, which will be collected and processed by our third-party payment processor (currently Stripe). We do not directly store your complete payment card details, though we may receive certain limited information (such as the last four digits of your card, expiration date, and billing information) for record-keeping and fraud prevention purposes.

  • Demographic Data: We may collect demographic information about you, including, but not limited to, through use of surveys to collect demographic information.

  • User Content: We may collect information that you submit when you contact us or you voluntarily submit content to Off The App.

  • Preferences:  You will be required to set your preferences (including opt-in choices and communication preferences), options and settings through your account.

2.2 Information you provide to us during onboarding as a client:

In addition to the information you provide during registration, set forth above, you may be requested to provide, or you may voluntarily provide, some or all of the information below during your onboarding as a client:

•           Education, professional and/or employment information.

•           Characteristics of protected classifications under federal law – such as race, religion, gender, or age, sexual orientation.

•           Visual information, such as photographs.

•           Hometown information.

•           Height.

•           Information regarding your interests and disinterests, including dating preferences.

•           Other information you voluntarily submit to or share with us in response to voluntary surveys or questionnaires, or otherwise, e.g. dating goals, personal values, food preferences, political beliefs, views on relationships/marriage/kids etc.

2.3 Information created when you use our service.  This may include:

  • Location Information: We may collect your approximate location information as determined through data such as GPS, IP address and Wifi.

  • Transaction Information: We collect transaction details related to your use of our services, including the type of services you requested, your order details, date and time the service was provided, amount charged, and payment method.

  • Usage Information: We collect information about how you interact with our services. This includes information such as access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and third-party sites or services. In some cases, we collect information through cookies, pixel tags, and similar technologies that create and maintain unique identifiers.

  • Device Information: We may collect information about the devices you use to access our services, including the hardware models, device IP address, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.

2.4 Information collected from other sources.  This may include:

  • User feedback

  • Users providing your information in connection with referral programs

  • Users requesting services on your behalf

  • Users or others providing information in connection with claims or disputes

  • Publicly available sources

  • Marketing service providers

3.     HOW WE USE INFORMATION

We use the information we collect to provide the Off The App services to you. All personal data is processed and stored securely in our database, for no longer than is necessary in light of the reason(s) for which it was first collected. We keep your information only so long as we need it to provide the Off The App service to you and fulfil the purposes described in this Policy. This is also the case for anyone that we share your information with and who carries out services on our behalf. When we no longer need to use your information and there is no need for us to keep it to comply with our legal or regulatory obligations, we will remove it from our systems.

With your permission, we use your email address and your other personal information to help us improve and deliver our services to you. The information disclosed to us is essential for our communication with you in connection with our activities (including, but not limited to, confirmation emails, newsletters, important updates affecting your relationship with Off The App). Kindly note that some of the communications may also include commercial messages, for instance banner ads, special offers, information about special events, promotions for Off The App or third parties’ goods and services.

We further use your personal information to customize content to your interests and preferences, and to contact you in connection with your transactions and other activities on Off The App.

By submitting your contact information on Off The App, you are opting in to receive emails from us. You have the right to withdraw your consent at any time. In order to stop receiving our emails after opting in, you have the option to contact us at cassandra@offtheappdating.com with UNSUBSCRIBE in the subject field or choose to UNSUBSCRIBE in the bottom of the email.

We will not send you any unsolicited marketing or spam and will take all reasonable steps to protect your rights and comply with our obligations under applicable legislation.

When you purchase, or register or make reservations for, products or services offered or sponsored by third parties, or elect to receive communications (such as emails or magazine subscriptions) or to participate in contests or other programs (such as discount or rewards programs), offered or sponsored by third parties on Off The App, you consent to our disclosing your personal information to those third parties. Those third parties may process your personal information pursuant to their own privacy policies. Additionally, you agree that we may use all such information so submitted to such third parties in the same manner in which we are entitled to use and disclose any other information you submit to us.

Third parties with whom we are allowed to share your personal data is authorized to use your personal information in compliance with our contractual arrangements with such third parties and in accordance with their own privacy policies, over which we have no control, and you consent that we bear no responsibility or liability regarding their actions or omissions.

4.     COOKIES, THIRD-PARTY TECHNOLOGIES AND INFORMATION COLLECTED BY AUTOMATIC MEANS

We may collect information by automated means, which may include cookies, web beacons, web server logs, and mobile SDKs.

  • Manner of Data Collection: The information we collect in such manners includes, but are not limited to, IP address, unique device identifier, device characteristics, browser characteristics, operating system and versions, language preferences, referring URLs, information on actions taken on the application, and dates and times of visits to the application.

  • Definitions:

    • A “cookie” is a small amount of data generated by a website and saved by your web browser to store information or settings in the browser.

    • A “web beacon” is a small image file, usually a transparent pixel image used for trafficking purposes. It may be placed in a webpage or HTML email to record when the content was loaded.

    • Software Development Kit (“SDK”) is a collection of software used for developing applications for a specific device or operating system.

    • A “Web Server” is a computer system that hosts websites.

    • “Clickstream Analysis” is the process of collecting, analyzing and reporting aggregate data regarding the pages a website visitor visits, and the order in which those pages are visited.

  • Why we use Cookies and other technologies to collect your data:

    • Authentication of application users

    • Remembering users’ preferences and settings

    • Assessing the popularity of content

    • Determining the success of marketing and advertising campaigns

    • Noting site traffic

    • Recording online behaviors, trends and interests of users that interact with our service.

5.     THIRD-PARTY ANALYTICS

We may allow third-party technology to provide analytics services. These third-parties may use cookies, web beacons, SDKs and other methods to identify your device when you visit our site, use our service, use our app, and when you visit other online sites and services.

The information third-party analytic services will collect shall be disclosed to or collected directly by the third-party analytics service providers.

6.     HOW WE USE FINANCIAL INFORMATION

Your financial information helps us to conduct a background check and verify your qualifications, to bill you for services and to enable you to participate in discount, rebate and similar programs in which you may elect to participate.

When you purchase, or register or make reservations for, products or services of third parties offered on Off The App, or when you participate in programs offered by Off The App but administered by third parties, which require that you disclose your financial information in order to use them; kindly note that these third parties may use your financial information in accordance with their own privacy policies, which we cannot control, and you consent that we have no responsibility or liability for any of their actions or omissions.

7.     SPECIAL CASES IN WHICH WE SHARE PERSONAL AND FINANCIAL INFORMATION

7.1 Transfer of the Business/Bankruptcy

Your personal information or financial information may be passed on to a third party in the event of a transfer of ownership or assets, or a bankruptcy.

Any private information that you have submitted and is relevant to any part of our business, that is being transferred, will be transferred along with that part. The new owner or new controlling party, under the terms of this Policy, will be authorized to use that data strictly and solely for the same purposes for which we initially collected them.

Please note that you will be contacted in advance in the event that we need to transfer your data in this manner. When contacted you will not, however, have the option to delete or withhold your data from the new owner or controller.

We may also disclose personal information or financial information when we determine that such disclosure is necessary to comply with applicable law, to cooperate with law enforcement or to protect the interests or safety of Off The App or its users.

We may also share information if disclosure would mitigate our liability in an actual or threatened lawsuit; if this would be necessary to protect our legal rights and legal rights of our clients and users, business partners or other interested parties; to enforce our agreements with you; and to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.

7.3 Explicit consent

We may ask for your consent to share your information with third parties. In any such case, we will be transparent about the reason for which we want to share the information.

7.4 Affiliated Parties

We also may disclose your personal or financial information to any affiliated legal entities and businesses with whom we are under common corporate control. All of our affiliated legal entities and businesses that receive your personal information, or financial information from us will comply with the terms of this Policy with respect to their use and disclosure of such information.

7.5 How We Use Public Information and Other Demographic Information

We may use public information to enable third parties to determine whether they offer suitable services for you. We may use demographic information to tailor our services and communications to your interests. We may also share demographic information with advertisers on an anonymous and aggregated basis (i.e., without telling the advertisers your identity). Our sharing of demographic information with advertisers is anonymous in accordance with this Policy.

The main reason we use your information is to deliver and improve our services.  As Off The App’s capabilities expand, we may use your information for one or more of the following reasons:

  • Comply with legal requirements, including but not limited to court orders, search warrants and subpoenas

8.     HOW WE SHARE INFORMATION

In order to assist you in making meaningful connections, we may share certain information about you with other users, as we share their information with you.  We also share some user information with third party service providers and partners who assist us in operating and improving our services.  In certain instances, your information may also be shared with legal authorities, such as law enforcement, or used for legal compliance purposes.

We may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.

Our Security Precautions

We have taken and will continue to take all available security measures to secure data submitted to us against loss, misuse, and alteration. We use secure server software (SSL), one of the best software currently available for secure commerce transactions subject to the industry standards. All of your personal and financial information is encrypted, and is stored on our servers in encrypted form.

Your information may be transferred to and maintained on computer networks which may be located outside of the state, province, country or other governmental jurisdiction in which you reside, and the country or jurisdiction in which these computer networks are located may not have privacy laws as protective as the laws in your country or jurisdiction.

9.     CHANGING OUR PRIVACY POLICY

We maintain the right to change this Policy from time to time (for example, if the law changes). Any changes will be immediately posted on the Website or we might inform you via email. You will be deemed to have accepted the terms of the Privacy Policy on your first use of Off The App or use of our services (online or offline) following these changes. We recommend that you check this page regularly to keep up-to-date.

10.  BREACH OF PRIVACY POLICY

We reserve the right to suspend or terminate accounts that violate this Policy or applicable law, subject to applicable legal requirements.

11.  UPDATING, CORRECTING OR DELETING YOUR INFORMATION

When making a request to update or delete your information, please include:

  1. Your full name and account details (if applicable);

  2. The specific information you would like to update, correct or delete; and

  3. Any supporting details necessary for us to verify the changes.

We will process your request as quickly as reasonably possible, typically within 45 calendar days of receipt. We may contact you to verify your identity before making any changes.

Please note that while we will make reasonable efforts to update your information, we cannot guarantee the removal of information that has been shared with third parties or already published in content accessible by other users.

Certain privacy laws may give you the right to review the personal information we keep about you.  You can request a list of your personal information kept by Off The App by making a written request for such to us at cassandra@offtheappdating.com.

12.  CALIFORNIA PRIVACY RIGHTS

12.1 For Minors
California residents under the age of 18 who use Off The App may request deletion of any user content or personal information they have posted. To make a request, you may:

  • Submit a request via email to cassandra@offtheappdating.com with the subject line “California Removal Request,” or

  • Use the user communication form available on the Website and the App.

Your request must include:

  1. A description of the content or information you want removed; and

  2. Information reasonably sufficient to allow us to locate that content.

We will respond to your request within 45 calendar days of receipt. We are not responsible for requests that are not submitted properly or do not provide sufficient information. Please note that a request may not result in complete removal if content has been republished or reposted by other users or third parties.

12.2 For all residents
If you are a California resident (18 years or older), you may also:

  1. Request a notice disclosing the categories of personal information we have shared with third parties for their direct marketing purposes in the preceding 12 months.

  2. Request that we delete personal information we have collected about you, and instruct third-party service providers to do the same.

  3. Request information about the categories of personal information we collect and how we use it.
